Article 1 — Purpose and Scope

These Terms and Conditions of Sale (TCS) apply, without restriction or reservation, to all sales of Luciole d’Or trophies and associated accessories (“Products”) offered by the Festival on its website.

Placing an order implies full and unconditional acceptance of these TCS.

The Festival may modify them at any time; the version applicable is the one in force on the order date.

Article 2 — Products, Customization, and Availability

Products are described on the website (materials, dimensions, options, engraved plate details, etc.).

Customized Products (e.g., engraved nameplates with film title, category, year) are made to order based on the information provided by the Customer.

In the exceptional event of unavailability, the Festival will promptly inform the Customer and propose a suitable alternative, a new delivery date, or a refund.

Article 3 — Prices

Prices are listed in euros, inclusive of all French taxes (TTC), but exclusive of import duties or taxes, which are the Customer’s responsibility depending on the destination country.

The Festival may adjust prices at any time; the price applicable is the one displayed at the time of the order.

Article 4 — Order and Confirmation

The Customer selects the Product, fills in the personalization details if applicable, then confirms the order.

Before payment, an order summary displays the items, quantities, prices, applicable fees, and estimated delivery time.

The order becomes final once payment is accepted and an email confirmation is issued.

The Festival reserves the right to refuse any order placed in bad faith or whose content violates applicable laws (e.g., illegal text requested for engraving).

Article 5 — Payment

Payment is due in full at the time of order, using the secure payment methods offered (such as credit card via Stripe).

Transactions are encrypted (SSL). Any payment incident is handled directly by the payment service provider.

Article 6 — Verification of Personalized Content (Proof / BAT)

For customized Products, when a proof (BAT — bon à tirer) or engraving preview is provided, it is sent by email.

If no reply is received within the stated deadline (or, by default, within 48 hours), the proof is deemed approved, and production begins.

The Customer guarantees the accuracy of all submitted information (spelling, accents, titles, logos) and warrants that they own the rights to any materials supplied.

Article 7 — Production, Shipping Times, and Delivery

Trophies are made to order and shipped within an estimated 10 to 35 business days, depending on production load, personalization, season, and destination.

Worldwide shipping is free, unless otherwise stated.

For orders shipped outside the European Union, possible customs duties or import taxes may apply and remain entirely at the Customer’s expense.

Payment is required at the time of order and is non-refundable for customized items, in accordance with Article L.221-28 of the French Consumer Code.

Delivery times are indicative. A delay in production or shipping shall not constitute grounds for cancellation or compensation unless expressly agreed in writing by the Festival.

An email with the tracking number is sent once the order is dispatched.

Article 8 — Delivery, Transfer of Risk, and Inspection

Delivery is deemed complete once the Product is handed over to the Customer or to any designated recipient at the specified address.

Upon receipt, the Customer must inspect the package and the Product. In case of damage or missing items, the Customer must:

  • note specific, detailed reservations on the carrier’s delivery slip, and 
  • notify the Festival within 48 hours at contact@world-film-festival.com, providing photos of the package, inner protection, and product.

    These steps are mandatory for any claim to be processed. 

Article 9 — Right of Withdrawal and Returns

  • Customized Products: No right of withdrawal (Article L.221-28 of the French Consumer Code — goods made to the consumer’s specifications or clearly personalized). 
  • Non-customized Products: 14-day right of withdrawal from receipt of goods.

    Returned items must be new, complete, unused, and properly protected.

    Return shipping costs and risks are borne by the Customer.

    Refunds (excluding any express delivery charges) are issued within 14 days after receipt and inspection of the returned item(s). 

To request a return, email contact@world-film-festival.com indicating the order number, reference(s), reason, and photos if relevant.

Article 10 — Non-Conformity, Defects, or Transport Damage

In case of non-conformity (e.g., engraving error versus approved proof) or transport damage duly substantiated, the Festival will offer repair, replacement, or refund.

Claims must be made within 7 days of receipt and include a description and supporting evidence (photos and/or videos, plus carrier report if applicable).

Article 11 — Customs and Import Taxes

For deliveries outside the European Union, customs duties and import taxes may apply under the destination country’s regulations.

Such charges are borne entirely by the Customer, who should check local requirements before ordering.

Article 12 — Warranty

Products are covered by the statutory warranties of conformity (Articles L.217-3 et seq. of the French Consumer Code) and hidden defects (Articles 1641 et seq. of the French Civil Code).

The warranty does not cover normal wear and tear, misuse, or damage occurring after delivery.

Article 13 — Intellectual Property

The design of the trophies, logos, trademarks (including Remember the Future®), and all website content are protected by intellectual property laws.

Any unauthorized reproduction or use is strictly prohibited.

The Customer warrants that they own the rights to any elements provided for customization and shall indemnify the Festival against any third-party claims.

Article 14 — Personal Data

Personal data collected are used for order processing, customer support, and legal compliance.

In accordance with the GDPR, Customers may exercise their rights of access, rectification, erasure, restriction, objection, and portability by writing to 📧 contact@world-film-festival.com or by post to the Festival’s registered address.

Article 15 — Liability and Force Majeure

The Festival cannot be held liable for any failure to perform due to the Customer, to an unforeseeable and insurmountable act of a third party, or to a force majeure event (external, irresistible, and unforeseeable circumstance).

Article 16 — Applicable Law, Disputes, and Mediation

These TCS are governed by French law.

In case of a dispute, the Customer may contact a Consumer Mediation Service (free of charge, per Article L.616-1 of the French Consumer Code) after first submitting a written complaint to the Festival.

If no amicable agreement is reached, the French courts shall have jurisdiction.
