General Terms and Conditions of Sale

ARTICLE 1. Field of application and object

The company K. Bomba Production, hereinafter referred to as “the Festival”, is a company registered under the number 817 532 070, whose head office is located at 7 Boulevard du Jeu de Ballon 06400 Grasse.

The Festival sells on the website https://www.world-film-festival.com/en, hereinafter referred to as “the Website”, cinema tickets that can be used in a cinema complex.

The present General Terms and Conditions of Sale are accessible at any time on the Website. They govern, without restriction or reservation, all contractual relations between the Festival and its individual customers wishing to purchase cinema tickets offered for sale on the Website.

The purchase of cinema tickets on the Internet Site is reserved for private individuals. The purchase of tickets by a professional or an agent with a view to their resale is prohibited.

The Customer acknowledges that he/she has the legal capacity to purchase cinema tickets or has the authorization of the authorized person.

Before placing an order, the Customer is required to read these General Terms and Conditions of Sale.

The fact of ordering cinema tickets on the Website implies full and complete acceptance of these General Terms and Conditions of Sale, which is expressly acknowledged by the Customer.

The present General Terms and Conditions of Sale apply to the exclusion of all other conditions, and in particular those applicable to sales within the cinema complex or by means of other distribution and marketing channels.

The present General Terms and Conditions of Sale may be modified at any time by the Festival. These modifications are only applicable as of the date they are posted on the Website and cannot be invoked against customers who have placed their order previously.

ARTICLE 2. Customer’s choice of movie screening and price of movie tickets

2-1 – Choice of movie screening by the Customer

For each movie screening offered, the Website includes a description specifying in particular the name of the film or alternative content and its characteristics (director, duration, synopsis, prohibition or restriction relating to the age of spectators, etc.); the date and time of the screening and its characteristics

From the Internet Site, the Customer chooses the movie session for which he/she wishes to purchase tickets.

It is expressly specified that the Customer is solely responsible for the choice of the film screening. It is up to the Customer to take into account any prohibition or restriction, particularly concerning the age of spectators, relating to the film or the alternative content shown.

2-2 – Price of cinema tickets

For each film session, the Website specifies the price of a seat for the different rates offered.

Ticket prices are expressed in Euros, all taxes included.

The Festival reserves the right to modify the ticket prices at any time or to apply promotional prices during certain periods.

However, the prices applied to the Customer are those in effect at the time the order is validated on the Website.

The Customer is solely responsible for the choice of the number and nature of the price of the tickets he/she wishes to purchase for the movie session he/she has chosen.

With regard to the number of seats, it is specified that the Customer may not purchase more than 20 cinema seats per order.

ARTICLE 3. ORDERING TICKETS

3-1 – Validation of the order

In order to place an order on the Website, it is up to the Customer to respect the following steps:

  • Choose the cinema session, as well as the number and type of tickets he/she wishes to purchase.
  • Fill in his identity and e-mail address
  • Read and accept the present general sales conditions. Checking the box “I have read and accept the general sales conditions” and clicking on the validate button is proof of the customer’s acceptance. Validate and pay for the order according to the terms and conditions of article 4 of the present general conditions of sale.
  • The information recorded by the Festival constitutes the sole proof of all orders placed by the Customer from the Website.

Once the Customer has validated his/her order on the Website, the Festival will send the Customer an e-mail confirming that his/her order has been taken into account. However, the Festival reserves the right to refuse to accept a customer’s order, particularly in the case of an incomplete or erroneous order. In the event that a customer’s order is not taken into account, the Festival agrees to reimburse the customer, within 14 days of the date the order was placed, for all sums paid by the customer.

An order is only definitively confirmed and binding on the Festival once an e-mail confirming the order has been sent to the Customer.

The movie ticket(s) purchased by the Customer are attached, in PDF format, to the e-mail confirming the order. The following information appears on each ticket: Les informations suivantes figurent sur chaque place :

  • Bar code or QR code of the sale
  • Name of the film or alternative content
  • Contact information for the movie theater where the ticket is valid
  • Session information, including time and date
  • The price of the ticket
  • Any promotional information

ARTICLE 4. PAYMENT

The price of the cinema tickets ordered is payable in full on the day the order is placed by the Customer, according to the following methods:

  • – Using a voucher: it is up to the Customer to enter the number and internet code of this voucher.
  • By secure payment by credit card: the cards accepted for the payment of a transaction are the cards of the networks Carte Bleue / Visa / Mastercard. Only one method of payment is authorized per order. Transactions made on the Website are secured by the “Stripe” payment system. All information exchanged to process the payment is encrypted thanks to an SSL type certification. It is not stored on the Website’s computer systems. ARTICLE 5. CANCELLATION, EXCHANGE, REFUND

In accordance with Article L 121-20-4 of the French Consumer Code, the sale of cinema tickets does not entitle the Customer to a right of withdrawal.

In the event of cancellation, postponement, or modification of a film session for which the Customer has purchased tickets, the Festival will notify the Customer as soon as possible by sending an e-mail to the address indicated in the Customer’s personal account. The Customer may then request an exchange or a full refund of the tickets.

Apart from the cases provided for in the above paragraph, the Customer may not request the cancellation of the sale or the exchange or refund of the tickets purchased on the Website.

ARTICLE 6. AVAILABILITY OF TICKETS

Orders for cinema tickets are placed in real time for a given cinema complex, film or alternative content, and a given cinema session. In this context, the Internet Site server informs the Customer in real time of the availability of cinema tickets when the order is placed. In the event of a system failure resulting in the sale of cinema tickets when the capacity of the selected cinema has been reached, the Customer may request an exchange or a full refund of his/her tickets.

ARTICLE 7. CONTROL AND ACCESS TO THE SCREENING ROOM

In order to gain access to the screening room of the film or the alternative content, the Customer must imperatively present, according to one of the two methods provided below, the tickets that he/she has purchased at the ticket control point of the cinema complex concerned.

Otherwise, access to the screening room will be denied and the tickets purchased will be permanently lost.

The Customer may choose to print the cinema tickets and present them directly at the ticket control point of the cinema complex concerned. To be valid, each cinema ticket must be printed in portrait mode, on a blank white A4 sheet of paper, both sides The Customer may print his or her cinema tickets in either black and white or color Good quality printing is required. Any partially printed, soiled, damaged or illegible ticket will not be accepted and will be considered invalid.

Customers may also present their tickets on a compatible cell phone or tablet. The Festival cannot be held responsible for the impossibility of reading the barcode on a PDF movie ticket in the event of a device with defects, such as a broken screen or others, or inadequacies such as brightness or battery.

It is expressly specified that the Festival cannot print the movie tickets purchased by the Customer and cannot be held responsible for the Customer’s inability to present his or her movie tickets, resulting in particular from

  • the Customer’s failure to consult the order confirmation e-mail;
  • the deletion by the Customer of the order confirmation e-mail;
  • the impossibility for the customer to access his/her e-mail;
  • a malfunction of the customer’s e-mail;
  • the loss, theft or forgetting of the cinema tickets by the customer.

It is reminded that each cinema ticket is intended for a single use by its holder. Any reproduction or counterfeiting is forbidden. The first person to present the ticket is considered to be the legitimate holder of this ticket. The Cinema and/or the Festival will refuse access to the cinema if it is proven that the ticket has already been presented at the control point.

In case of refusal of access to the theater, the bearer of the ticket will not be entitled to a refund.

It is reminded that the use of a reproduced or falsified ticket is liable to criminal prosecution for its bearer.

Once the time limit for entry into the theater mentioned on the ticket has expired, the customer will not be allowed to enter the theater and will not be entitled to any refund.

In the event that several tickets have been purchased with the same order placed on the Website, the said tickets are grouped together by a single QR Code. Thus, in order to allow access to the theater at different times between the beneficiaries of the order grouping several tickets, it is necessary to print as many tickets as there are beneficiaries, or to transfer the order confirmation e-mail to all the beneficiaries.

In the event that the Customer orders several seats, he/she must ensure that the person(s) to whom he/she offers the seat(s) has (have) fully understood these General Terms and Conditions of Sale and that he/she has (have) agreed to abide by them.

ARTICLE 8. INTELLECTUAL PROPERTY

The contents of the Website are protected by French and international laws relating to intellectual property.

Any total or partial reproduction of these contents is strictly forbidden and is likely to constitute an offence of counterfeiting.

ARTICLE 9. Processing of personal data

When the Customer orders and buys a ticket on the Website, his personal data are collected. The personal data collected are the following:

  • the name and surname of the Customer, his/her e-mail address

The personal data collected is intended for the Festival. It is processed by computer for the purpose of processing the order, managing relations with the Customer, processing the Customer’s requests, as well as for commercial solicitation of the Customer.

The Customer’s personal data are kept for a period of 5 years from the last order, unless :

  • the Customer exercises his right to delete the data, under the conditions described below;
  • a longer conversation period is authorized or imposed by virtue of a legal or regulatory provision.
    During this period, the Festival undertakes to put in place all appropriate means to ensure the confidentiality and security of personal data, so as to prevent their damage, deletion or access by unauthorized third parties.

Access to the Customer’s personal data is strictly limited to Festival personnel.

Apart from the above statements, the Festival will not sell, rent, transfer or give access to third parties to the Customer’s personal data without the Customer’s prior consent, unless compelled to do so for a legitimate reason (legal obligation, fight against fraud or abuse, exercise of the rights of defense, etc.).

Personal data collected may be shared with third party companies in the following cases :

  • To comply with administrative or legal proceedings;
  • If the Festival is involved in a merger, acquisition, sale of assets or receivership, it may be required to sell or share all or part of its assets, including personal data. In this case, the Customer will be informed, before the personal data is transferred to a third party.

Pursuant to the amended “Informatique et Libertés” law of January 6, 1978 and the European Regulation No. 2016/679/EU of April 27, 2016 (applicable as of May 25, 2018), the Customer has the right to access, rectify, portability and deletion of his data or to limit the processing. He may also, for legitimate reasons, object to the processing of data concerning him.

Subject to the production of a valid proof of identity, the Customer can exercise his rights by writing to the following address :

If the Customer does not wish to receive news from the Festival and solicitations (by phone, SMS, mail or e-mail) and invitations, the Customer must indicate this to the Festival at the above-mentioned address.

For any additional information or complaint, the Customer may contact the Commission Nationale de l’Informatique et des Libertés (more information at www.cnil.fr).

ARTICLE 10. RESPONSIBILITY

It is reminded that the Festival cannot be held responsible for the non-execution of its commitments in case of force majeure.

ARTICLE 11. APPLICABLE LAW AND DISPUTES

The present general conditions of sale, as well as all contractual relations that they aim to govern, are subject to French law.

The customers are informed that they can resort, in the event of dispute, to a conventional mediation, in particular near an organization of mediation of consumption (article L. 616-1 of the Code of consumption) or near the existing authorities of sectorial mediation, or with any alternative mode of settlement of the disputes (conciliation, for example).
