Article 1 \u2014 Purpose and Scope<\/b><\/h3>\n

These Terms and Conditions of Sale (TCS) apply, without restriction or reservation, to all sales of <\/span>Luciole d\u2019Or trophies<\/b> and associated accessories (\u201cProducts\u201d) offered by the Festival on its website.<\/span><\/p>\n

Placing an order implies full and unconditional acceptance of these TCS.<\/span><\/p>\n

The Festival may modify them at any time; the version applicable is the one in force on the order date.<\/span><\/p>\n

Article 2 \u2014 Products, Customization, and Availability<\/b><\/h3>\n

Products are described on the website (materials, dimensions, options, engraved plate details, etc.).<\/span><\/p>\n

Customized Products (e.g., engraved nameplates with film title, category, year) are made to order based on the information provided by the Customer.<\/span><\/p>\n

In the exceptional event of unavailability, the Festival will promptly inform the Customer and propose a suitable alternative, a new delivery date, or a refund.<\/span><\/p>\n

Article 3 \u2014 Prices<\/b><\/h3>\n

Prices are listed in <\/span>euros, inclusive of all French taxes (TTC)<\/b>, but <\/span>exclusive of import duties or taxes<\/b>, which are the Customer\u2019s responsibility depending on the destination country.<\/span><\/p>\n

The Festival may adjust prices at any time; the price applicable is the one displayed at the time of the order.<\/span><\/p>\n

Article 4 \u2014 Order and Confirmation<\/b><\/h3>\n

The Customer selects the Product, fills in the personalization details if applicable, then confirms the order.<\/span><\/p>\n

Before payment, an order summary displays the items, quantities, prices, applicable fees, and estimated delivery time.<\/span><\/p>\n

The order becomes final once <\/span>payment is accepted<\/b> and an <\/span>email confirmation<\/b> is issued.<\/span><\/p>\n

The Festival reserves the right to refuse any order placed in bad faith or whose content violates applicable laws (e.g., illegal text requested for engraving).<\/span><\/p>\n

Article 5 \u2014 Payment<\/b><\/h3>\n

Payment is due <\/span>in full at the time of order<\/b>, using the secure payment methods offered (such as credit card via Stripe).<\/span><\/p>\n

Transactions are encrypted (SSL). Any payment incident is handled directly by the payment service provider.<\/span><\/p>\n

Article 6 \u2014 Verification of Personalized Content (Proof \/ BAT)<\/b><\/h3>\n

For customized Products, when a proof (BAT \u2014 <\/span>bon \u00e0 tirer<\/span><\/i>) or engraving preview is provided, it is sent by email.<\/span><\/p>\n

If no reply is received within the stated deadline (or, by default, within 48 hours), the proof is deemed <\/span>approved<\/b>, and production begins.<\/span><\/p>\n

The Customer guarantees the accuracy of all submitted information (spelling, accents, titles, logos) and warrants that they own the rights to any materials supplied.<\/span><\/p>\n

Article 7 \u2014 Production, Shipping Times, and Delivery<\/b><\/h3>\n

Trophies are <\/span>made to order<\/b> and shipped within an <\/span>estimated 10 to 35 business days<\/b>, depending on production load, personalization, season, and destination.<\/span><\/p>\n

Worldwide shipping is free<\/b>, unless otherwise stated.<\/span><\/p>\n

For orders shipped <\/span>outside the European Union<\/b>, possible <\/span>customs duties or import taxes<\/b> may apply and remain entirely at the Customer\u2019s expense.<\/span><\/p>\n

Payment is required at the time of order and is <\/span>non-refundable for customized items<\/b>, in accordance with Article L.221-28 of the French Consumer Code.<\/span><\/p>\n

Delivery times are indicative. A delay in production or shipping shall not constitute grounds for cancellation or compensation unless expressly agreed in writing by the Festival.<\/span><\/p>\n

An email with the tracking number is sent once the order is dispatched.<\/span><\/p>\n

Article 8 \u2014 Delivery, Transfer of Risk, and Inspection<\/b><\/h3>\n

Delivery is deemed complete once the Product is handed over to the Customer or to any designated recipient at the specified address.<\/span><\/p>\n

Upon receipt, the Customer must inspect the package and the Product. In case of damage or missing items, the Customer must:<\/span><\/p>\n

    \n
  • note specific, detailed reservations on the carrier\u2019s delivery slip, and<\/span> <\/li>\n
  • notify the Festival within 48 hours at <\/span>contact@world-film-festival.com<\/b>, providing photos of the package, inner protection, and product.<\/span>
    \n<\/span>
    \n<\/span> These steps are mandatory for any claim to be processed.<\/span> <\/li>\n<\/ul>\n

    Article 9 \u2014 Right of Withdrawal and Returns<\/b><\/h3>\n
      \n
    • Customized Products:<\/b> No right of withdrawal (Article L.221-28 of the French Consumer Code \u2014 goods made to the consumer\u2019s specifications or clearly personalized).<\/span> <\/li>\n
    • Non-customized Products:<\/b> 14-day right of withdrawal from receipt of goods.<\/span>
      \n<\/span>
      \n<\/span> Returned items must be <\/span>new, complete, unused, and properly protected<\/b>.<\/span>
      \n<\/span>
      \n<\/span> Return shipping costs and risks are borne by the Customer.<\/span>
      \n<\/span>
      \n<\/span> Refunds (excluding any express delivery charges) are issued within <\/span>14 days<\/b> after receipt and inspection of the returned item(s).<\/span> <\/li>\n<\/ul>\n

      To request a return, email <\/span>contact@world-film-festival.com<\/b> indicating the order number, reference(s), reason, and photos if relevant.<\/span><\/p>\n

      Article 10 \u2014 Non-Conformity, Defects, or Transport Damage<\/b><\/h3>\n

      In case of non-conformity (e.g., engraving error versus approved proof) or transport damage duly substantiated, the Festival will offer repair, replacement, or refund.<\/span><\/p>\n

      Claims must be made <\/span>within 7 days<\/b> of receipt and include a description and supporting evidence (photos and\/or videos, plus carrier report if applicable).<\/span><\/p>\n

      Article 11 \u2014 Customs and Import Taxes<\/b><\/h3>\n

      For deliveries <\/span>outside the European Union<\/b>, customs duties and import taxes may apply under the destination country\u2019s regulations.<\/span><\/p>\n

      Such charges are <\/span>borne entirely by the Customer<\/b>, who should check local requirements before ordering.<\/span><\/p>\n

      Article 12 \u2014 Warranty<\/b><\/h3>\n

      Products are covered by the statutory warranties of <\/span>conformity<\/b> (Articles L.217-3 et seq. of the French Consumer Code) and <\/span>hidden defects<\/b> (Articles 1641 et seq. of the French Civil Code).<\/span><\/p>\n

      The warranty does not cover normal wear and tear, misuse, or damage occurring after delivery.<\/span><\/p>\n

      Article 13 \u2014 Intellectual Property<\/b><\/h3>\n

      The design of the trophies, logos, trademarks (including <\/span>Remember the Future\u00ae<\/b>), and all website content are protected by intellectual property laws.<\/span><\/p>\n

      Any unauthorized reproduction or use is strictly prohibited.<\/span><\/p>\n

      The Customer warrants that they own the rights to any elements provided for customization and shall <\/span>indemnify the Festival<\/b> against any third-party claims.<\/span><\/p>\n

      Article 14 \u2014 Personal Data<\/b><\/h3>\n

      Personal data collected are used for order processing, customer support, and legal compliance.<\/span><\/p>\n

      In accordance with the GDPR, Customers may exercise their rights of access, rectification, erasure, restriction, objection, and portability by writing to \ud83d\udce7 <\/span>contact@world-film-festival.com<\/b> or by post to the Festival\u2019s registered address.<\/span><\/p>\n

      Article 15 \u2014 Liability and Force Majeure<\/b><\/h3>\n

      The Festival cannot be held liable for any failure to perform due to the Customer, to an unforeseeable and insurmountable act of a third party, or to a <\/span>force majeure<\/b> event (external, irresistible, and unforeseeable circumstance).<\/span><\/p>\n

      Article 16 \u2014 Applicable Law, Disputes, and Mediation<\/b><\/h3>\n

      These TCS are governed by <\/span>French law<\/b>.<\/span><\/p>\n

      In case of a dispute, the Customer may contact a <\/span>Consumer Mediation Service<\/b> (free of charge, per Article L.616-1 of the French Consumer Code) after first submitting a written complaint to the Festival.<\/span><\/p>\n
